The petitioner seeks pre-arrest bail in connection with N.D.P.S. Case No. 4 of 2018 arising out of Case No. 293C2/18, pending in the Court of the Sessions Judge-cum-Special Judge, NDPS, Jamui, for the offence alleged under Section 20(B) of the Narcotic Drugs and Psychotropic Substances Act. The accusation is of recovery of 40 Kg ganja from Maruti Suzuki SX4 car, bearing registration no. DL3CAZ/5714, which was being driven by Sumit Kumar. Later on, the vehicle was found in the name of the petitioner.
The submission is that petitioner had purchased the seized vehicle in second hand and the same was handed over to co-accused, Sumit Kumar, to ply on fare and Sumit Kumar. The
Patna High Court CR. MISC. No.61776 of 2019(2) dt.14-10-2019 2/2 petitioner had no knowledge about use of his vehicle for carrying the ganja, which is said to be recovered from the vehicle of the petitioner.
Learned Additional Public Prosecutor for the State opposes the prayer for pre-arrest bail.
Having regard to the facts and circumstances of the case, I am not inclined to grant the privilege of pre-arrest bail to the petitioner. The prayer for pre-arrest bail is rejected. The petitioner is directed to surrender before the Court below and seek regular bail, which will be considered on its own merit and without being prejudiced of this order.
