JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 18-02-2016 The petitioner apprehends his arrest in a criminal prosecution registered under Sections 467, 468, 471, 406, 408, 420 and 120B of the Indian Penal Code.
Taking into consideration the fact that the petitioner happens to be an employee of the Bank in question and the allegation is of cheating and misappropriation of more than Rs. 18 lacs and further taking into consideration the fact that the petitioner is specifically named in the first information report vide Annexure-1 as an accused with certain specific allegations against him and others, this Court is not inclined to accede to the prayer made on behalf of the petitioner for grant of anticipatory bail. Accordingly, his prayer for grant of anticipatory bail in connection with Pirbahor P.S.Case 305 of 2014 pending in the court of the learned Judicial Magistrate, 1st Class, Patna is rejected. However, if the petitioner surrenders in the court below within a period of four weeks from today and applies for regular bail, then the same shall be considered and decided on its own merits without being prejudiced by the present order.
