JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-06-2020 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing. Heard the learned counsel for the petitioner and the learned counsel appearing for the respondents.

The present writ petition has been filed for directing the respondents i.e. the officials of the Bihar State Co-operative Land Development Bank,

Patna High Court CWJC No.18674 of 2019(3) dt.18-06-2020 2/3 Patna to make payment of the Provident Fund amount, leave encashment, group insurance and arrears of salary to the petitioner herein. The petitioner has further prayed to quash the letter dated 30.12.2016 issued by the Managing Director, Multi-state Cooperative Land Development Bank, Patna, whereby the joining of the petitioner in the Bank has been refused, after returning from BSFCSC since the petitioner has been dismissed from service vide letter dated 12.08.2010.

At this stage, Shri Rajesh Prasad Choudhary, the learned counsel appearing for the respondent Bank, has raised a preliminary objection regarding maintainability of the present writ petition in view of the judgment rendered in the case of The Organizer, Dehri C.D. & C.M. Union Limited vs. The State of Bihar & Ors., reported in 2014(1) PLJR 695.

At this juncture, the learned counsel appearing for the petitioner seeks to withdraw the present writ petition with liberty to approach the appropriate forum.

Patna High Court CWJC No.18674 of 2019(3) dt.18-06-2020 3/3 Accordingly, the writ petition stands disposed of as withdrawn with liberty to the petitioner to move the appropriate forum for redressal of his grievances.
