JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2019 Petitioner apprehends his arrest in connection with Bihta P.S. Case No. 596 of 2017 registered for the offences punishable under Sections 379, 201 and 120B/34 of the Indian Penal Code.
Allegation as per FIR is that 23 Poklen machines were seized, including of the petitioner and thereafter out of that 13 Poklen machines were found missing from the place of occurrence and petitioner was suspected for the same. Submission of learned counsel for the petitioner is that nothing has been recovered from his possession and he has no hand in removing the machines.
Heard learned APP also, who has opposed the prayer for anticipatory bail of the petitioner.
