2. This application has been filed for quashing of the order dated 18.04.2015 by which learned S.D.J.M., Pupari, Sitamarhi has taken cognizance against the petitioner in Tr. No. 1512/2015, corresponding to Sitamarhi Complaint Case No. 77 of 2014, registered for the offence under Section 498A of the Indian Penal Code.

3. As per prosecution case, petitioner got married with opposite party no. 2 in year 2011. It was alleged that petitioner is a handicapped person. After three months of marriage petitioner started torturing his wife for motorcycle. After sometime she came to know that petitioner had illicit

Patna High Court CR. MISC. No.16315 of 2016(3) dt.13-09-2023 2/2 relationship with one widow. On 29th August, the petitioner assaulted her she came back to Sitamarhi to her sister's house. It was further alleged that matter was tried to be settled. Lastly, she filed the complaint case against the petitioner.

4. The petitioner is the husband of the opposite party no. 2 and there are serious allegations levelled against him.
