The petitioners have renewed their prayer for anticipatory bail in a case registered for the offences punishable under Sections 341, 323 and 302/34 of the Indian Penal Code.
The prayer of the petitioners was earlier rejected vide Cr. Misc. No. 11745 of 2013 by a co-ordinate Bench of this Court (now retired).
It is submitted by learned counsel for the petitioners that the accusation is that the petitioners alleged to have pressed the testicles of the victim but the post-mortem
Patna High Court Cr.Misc. No.20036 of 2016 (2) dt.05-05-2016 2/2 report reflects the cause of death as strangulation. This contention was advanced by the learned counsel for the petitioners when earlier bail application was considered.
Hence, in view of the above facts, this Court is not inclined to interfere. But, keeping in view of the fact that the petitioners are ladies and the accusation is not being corroborated by the medical opinion, it is a case for consideration of prayer for regular bail, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Singhia P.S. Case No. 57 of 2012 pending in the court of learned Additional Chief Judicial Magistrate, Rosera, District - Samastipur.
