JUSTICE SUDHIR SINGH ORAL ORDER 02-03-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case, in brief, is that in a marriage ceremony at the time of reception of Barat Party due to firing two boys sustained fire shot injuries, of which Abhishek Kumar was grandson of the informant. Abhishek Kumar was rushed to P.M.C.H., Patna but he died on the way.

It is submitted on behalf of the petitioner that merely on the basis of hearsay witness he has been made accused in the present case. There is no eye witness to the alleged occurrence. Along with the deceased one person was also said to have been injured in the alleged occurrence. He has also not taken the name of the petitioner.

On behalf of the State, it is submitted that petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on

Patna High Court Cr.Misc. No.56130 of 2015 (3) dt.02-03-2016 2/2 furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna, in connection with Phulwarishariff (Janipur) P.S. Case no. 337 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
