JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 26-05-2016 Petitioner apprehends his arrest in Sahebganj P.S. Case No.36 of 2015 instituted for the alleged offences under Sections-341, 323, 379, 387/34 of the Indian Penal Code, pending before Sub-Divisional Judicial Magistrate, (West) Muzaffarpur.
Learned counsel for the petitioner submits that in course of investigation no witness has alleged the presence of the petitioner but the fact remains that after due supervision by the higher authorities charge-sheet has been submitted against other accused persons and investigation is pending against the petitioner. Learned counsel further submits that all other persons were armed and who allegedly snatched the money have already been arrested and granted bail by the learned trial Court itself.
Be that as it may, in the facts and circumstances aforesaid, I am not inclined to interfere in the matter. However, if the petitioner surrenders before the learned Court below within
Patna High Court Cr.Misc. No.14975 of 2016 (03) dt.26-05-2016 2/2 four weeks and seeks regular bail, his prayer would be considered on its own merit without being prejudiced by order of this Court. Accordingly, this application is dismissed.
