Petitioner apprehends his arrest in a case registered for the offence under Section 30(a)/37(d) of the Bihar Prohibition & Excise Act.

One bottle of 750 ml. foreign liquor, 10 disposable glasses, two wrapper of whiskey and one Samsung Keypad mobile have been recovered from the house of this petitioner. Since recovery has been made from the house of this petitioner, this application for grant of anticipatory bail to the petitioner is not maintainable, in view of Full Bench decision of this Court rendered in the case of Ram Vinay Yadav vs. The State of Bihar reported in 2019(2) P.L.J.R. 1089 (F.B.).
