This is the second attempt on behalf of the petitioner for grant of regular bail in connection with Rosera P.S. Case No.275 of 2022 registered for the offence punishable under sections 302 & 201/34 of the Indian Penal Code. 3.

Earlier, the prayer of the petitioner for grant of bail has been rejected vide order dated 05.03.2024 passed in Criminal Miscellaneous No.80972 of 2023.

The petitioner is the husband of the deceased. He is said to have killed his wife. The petitioner is in jail since 20.08.2022.

It has been submitted by learned counsel for the petitioner that the charges have been framed on 15.04.2023 but not even a single witness has been examined till date. 6.

From the report of the trial Court dated 25.01.2025, it appears that no witness has been examined in the trial despite the petitioner being in jail for more than two years. 7.

Considering the period of custody of the petitioner and also the fact that the trial is being delayed by the prosecution, this bail application is allowed. 8.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 1st, Rosera, DistrictSamastipur/concerned Court, in connection with Rosera P.S. Case No.275 of 2022, subject to the condition that he will cooperate in the trial and will appear personally or through his advocate on the date fixed in the trial.
