====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 15-11-2025 Heard learned counsel for the petitioner, learned A.P.P. for the State.
2. The petitioner seeks regular bail in a case registered under Sections 126(2), 115(2), 118(2), 109, 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.
3. As per the prosecution case, it is alleged that three unknown miscreants fired on the son of the informant causing gunshot injury.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case merely on suspicion. Further submission is that petitioner is not named in the F.I.R. and during course of investigation, on the basis of call detail, his name has been transpired. Allegation against the petitioner is that he always talking with the son of informant and has given location to the other co-accused
Patna High Court CR. MISC. No.57524 of 2025(3) dt.15-11-2025 2/2 persons. Petitioner and informant's son are of the same village and petitioner has good terms with the son of the informant. There is no allegation of overt act against the petitioner. Petitioner is a student aged about 22 years. Although, petitioner has two criminal antecedents but the same arise from one occurrence. Petitioner is on bail in both the cases. There is no chance of absconding of the petitioner or tampering with the evidence. The charge-sheet has already been submitted after completion of investigation. Petitioner is in custody since 12.04.2025 and he undertakes to cooperate in the trial.
5. Learned A.P.P. for the State opposed the bail application of the petitioner.
6. Considering the facts and circumstances of the case, the submissions of learned counsel for the parties and period of custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned in connection with Alamnagar P.S. Case No.12 of 2025.
