Heard learned counsel for the petitioner and learned A.P.P. for the State, Shri Rabindra Kumar. 2.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 325, 326, 307, 376, 511 and 34 of the IPC.

The S.H.O, Garkha P.S, along with the Investigating Officer of the case, in compliance of the order dated 9-9-2025, are present in the Court.

The Investigating Officer of the case submits that the case has been investigated and allegation of attempting to commit rape has been found false. It is also submitted that mother of the petitioner died on 18-6-2024 and the occurrence is alleged to have taken place on 22-6-2024. It is next submitted that the independent witnesses during the course of investigation

Patna High Court CR. MISC. No.58783 of 2025(3) dt.15-09-2025 2/3 stated that since mother of the petitioner had died as such a pot was hung on a tree which was broken by the informant on account of which a dispute arose.

At this stage, the learned counsel appearing on behalf of the petitioner submits that it is a fact that an altercation had taken place in between the family members of the petitioner and the informant as informant had broken the pot hung on a tree in accordance with rituals after the mother of the petitioner died. It is further submitted that falsity of the allegation also manifests from the fact that the date of occurrence is 22-6-2024, a complaint came to be instituted on 26-7-2024 based on which the instant FIR was instituted on 16-8-2024.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Garkha P.S. Case

Patna High Court CR. MISC. No.58783 of 2025(3) dt.15-09-2025 3/3 No. 511 of 2024, subject to the conditions as laid down under Section 482 (2) of the BNSS.

The personal appearance of the S.H.O, Garkha P.S, along with the Investigating Officer of the case, is dispensed with.
