The petitioners seek bail in connection with Barun P. S. Case No.360 of 2021, instituted for the offences under Section 30(a) of the Excise Act, 2018.

The learned counsel for the petitioners submits that the petitioners are in custody since 30.10.2021, they are persons with clean antecedent and charge-sheet has been submitted in the case.

Allegation is of recovery of 411 litre of liquor from a Swift car and the petitioners were arrested from the car. The learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.69894 of 2021(2) dt.25-02-2022 2/2 petitioners are neither the owner, nor the driver of the car. They had merely taken lift and came to be implicated when search was made without knowing that what was loaded in the car. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioners are in custody, they are persons with clean antecedent and chargesheet has been submitted in the case, the petitioners, abovenamed, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II-cumSpecial Judge Excise, Aurangabad in connection with Barun P. S. Case No.360 of 2021.

The application stands allowed.
