2. Petitioner seeks regular bail in a case registered under Section 30(a) of the Bihar Prohibition and Excise Act.

3. There is recovery of 81 litres Nepali liquor from bags loaded on Glamour motorcycle.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The apprehended accused Chandra Bhushan Kumar has named the petitioner stating that the said liquor was to be delivered to the petitioner. Except disclosure statement, there is nothing against the petitioner. Petitioner was not arrested on the spot rather he was arrested later on. Petitioner is neither the owner of the motorcycle nor he has any concern with the seized

Patna High Court CR. MISC. No.57929 of 2025(2) dt.04-09-2025 2/2 liquor. Nothing has been recovered from conscious possession of the petitioner. Petitioner has one criminal antecedent of similar nature in which he is on bail. Petitioner is in jail since 26.06.2025. Petitioner undertakes to cooperate in the investigation and the trial.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case as well as the submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.2, East Champaran at Motihari in connection with Mahuawa P.S. Case No.08 of 2025.
