JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-12-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are said to have been caught by the police along with stolen motorcycles when they along with others assembled to make deal of the aforesaid motorcycles. The contention on behalf of the petitioners is that as a matter of fact, the stolen motorcycles were recovered near the house of petitioner no. 1 and the police could not succeed to nab the actual culprits and thereafter implicated the petitioners in the alleged crime. It is also contended on behalf of the petitioners that petitioners do not have any criminal antecedent which has specifically been pleaded at para-3 of the petition.
