JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-05-2019 The father of the petitioner, who was a PDS licensee, died below the age of 58 years but only in the year 2012. In the same year, the petitioner made an application before the concerned authority for grant of such license on compassionate ground. Along with the license, the petitioner also annexed all the necessary documents including the relinquishment of the claim of the other relatives of his father who are also entitled to be granted license on compassionate ground. Till the mid of 2019, no decision has been taken. Despite several correspondences of the petitioner with the concerned

The learned counsel for the petitioner has submitted that though many years have passed by since his father predeceased, nonetheless, the concerned authority was required to pass an order on such representation by the petitioner.

Under the aforesaid circumstances, this Court deems it appropriate to direct the petitioner to make a fresh representation before the Sub-Divisional Officer, Banka (respondent No. 2) annexing the application and all other necessary facts and documents as also the correspondences between the petitioner and the concerned respondent within a period of six weeks from today. On receipt of such representation/application, the concerned respondent shall pass a reasoned order in accordance with law within a further period of six weeks thereafter.

With the aforesaid observation/direction, the
