JUSTICE RAKESH KUMAR ORAL ORDER 15-12-2016 Sri Anil Kumar, learned counsel for the petitioner and Sri Vijay Shankar Shrivastava, learned counsel, who has appeared on behalf of the complainant/Opp.Party no.2, in presence of Sri Laxmi Kant Sharma, learned Addl. Public Prosecutor, submit that compromise has already been arrived in between the parties and a petition for compromise was filed before the court below.

Keeping in view the fact that the dispute in between the parties has already been settled outside the court, there is no reason to allow the proceeding in Complaint Case No.472/2013 pending in the court of Sri J.K.Singh, learned Judicial Magistrate,

Patna High Court Cr.Misc. No.28910 of 2013 (3) dt.15-12-2016 2/2 Motihari /concerned court. Accordingly, entire proceeding in Complaint Case No. 472/2013 (T.R. No.4761 of 2013) is hereby set aside.

The petition stands allowed.
