The petitioner seeks bail in connection with Kotwali P.S. Case No.453 of 2015 registered under Sections 406 and 420 of the Indian Penal Code.

The accusation is that co-accused Amrita Kumari alias Amrita Raj, the wife of the petitioner, took loan of Rs.35000/- and Rs.37500/- from Sonata Finance Private Limited but the loan has not been deposited by her. It is also alleged that the loan has been taken by the co-accused, Amrita Kumari alias Amrita Raj, the wife of the petitioner, for the purpose of doing business by her husband/this petitioner.

Patna High Court Cr.Misc. No.55379 of 2015 (3) dt.03-02-2016 2/2 Learned counsel appearing on behalf of the petitioner submits that the petitioner is the husband of the co-accused, Amrita Kumari alias Amrita Raj, who had taken the aforesaid loan from the Sonata Finance Private Limited, and has falsely been implicated in this case. It is further submitted that the petitioner having no criminal antecedent is in custody since 29.10.2015. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Kotwali P.S. Case No.453 of 2015.
