02-05-2016 Two petitioners, who were named in the F.I.R. in Uphora (Daudnagar) P.S. Case No. 37 of 2012 (corresponding to Sessions Trial No.104 of 2013/19 of 2013) registered for offence under Section 302 and other allied sections of the Indian Penal Code and Section 27 of the Arms Act, 1959, have prayed for quashing of an order dated 03-05-2013 passed by learned Adhoc Addl. District & Sessions Judge I, Aurangabad, whereby the petition for discharge was rejected.
Sri Nand Kishore Prasad, learned Addl. Public Prosecutor submits that it is a double murder case, in which, there is specific accusation against both the petitioners for
Patna High Court Cr.Misc. No.29141 of 2013 (2) dt.02-05-2016 2/2 participating in the occurrence. He further submits that the learned Sessions Judge, while rejecting the discharge petition, has considered the material and passed the order. I have also perused the material on record, particularly; the impugned order and F.I.R. I do not find any ground to interfere with the order.
The petition stands dismissed.
Let a copy of this order be sent to the court below, with an observation that learned court below may take appropriate steps so that the case may come to its logical end without unnecessary delay.
