JUSTICE MOHIT KUMAR SHAH ORAL ORDER 27-03-2019 The learned counsel for the opposite parties has submitted that the order dated 4.3.2015 passed in CWJC No. 21893 of 2011, disobedience whereof has been complained of in the present contempt petition, was challenged by the aforesaid parties in LPA No. 88 of 2016 and the learned Division Bench by a judgment dated 8.2.2017 passed in the said LPA No. 88 of 2016 had dismissed the appeal, however, with a direction that One Member Committee comprising of Hon'ble Mr. Justice Uday Sinha, a retired Judge of this Court, shall disburse the amount in question in accordance with law. Thereafter, it appears that the matter had travelled to the Hon'ble Supreme Court in SLP (C) No.
16159 of 2017 and the Hon'ble Supreme Court by an order dated 23.7.2018 disposed of the said SLP with an observation that since requisite action has been taken by the State Government with respect to the employees of the various Corporations, nothing further is required to be done in the matter.
Patna High Court MJC No.1343 of 2016(6) dt.27-03-2019 3/3 The learned counsel for the petitioners does not dispute the aforesaid position existing in law as also on facts. Having regard to the facts and circumstances of the case, this Court feels that there is no need to proceed further in the present contempt petition, hence, the contempt petition is dismissed.
