The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 376, 511/34 of the Indian Penal Code.
It is alleged that the petitioner made an attempt to outrage the modesty of the informant. On alarm being raised her son came and saved her. It is further alleged that the petitioner was caught hold by the informant and her son but in the meantime petitioner's son Lakhindra Sahni came and assaulted on the head of the son of the informant with bamboo. It is submitted by learned counsel for the petitioner that the FIR was registered under sections 376 and other sections of the IPC but on completion of investigation, the
Patna High Court Cr.Misc. No.55279 of 2015 (2) dt.07-12-2015 2/2 charge-sheet has been submitted under sections 341, 323, 324, 354/34 of the Indian Penal Code. Moreover, co-accused Lakhendra Sahni has been granted anticipatory bail by the learned court below. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Nanpur P.S. Case No.113 of 2013, pending before the learned CJM, Sitamarhi.
With the above observation, this application is, accordingly, disposed off.
