105 liters of Mahua liquor and 500 quintals of Chowa are said to have recovered from the house of the petitioner for which the petitioner is in custody since 06.08.2015. No doubt, the occurrence is said to have taken place in the year 2009 and petitioner could be arrested on 06.08.2015 but submission on behalf of the petitioner is that petitioner was outside the State and, as a matter of fact, the recovery was made from dilapidated house of the petitioner. Moreover, the petitioner does not have any criminal antecedent.
Considering the facts aforesaid and submission of the
Patna High Court Cr.Misc. No.4705 of 2016 (2) dt.11-02-2016 2/2 parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/ - (ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Rashmi Prasad, learned Judicial Magistrate, 1st class, Hilsa, Nalanda in connection with Complaint case No.1392C/2009, subject to condition that one of the sureties must be close relative of the petitioner as well as holder of landed property.
