The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 149, 323, 324, 307, 379, 427 and 447 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioner nos. 4, 5, 6 and 7 are persons with clean antecedent

No.69775 of 2021(3) dt.26-07-2022 2/3 whereas petitioner nos. 1, 2 and 3 have got antecedent of one case each and the informant alleges that altogether 15 accused persons, including the petitioners, along with 8-10 unknown accused came to the house of the informant and started assaulting the informant and his family members who sustained injuries and they even cut about 22-25 trees of sangwan and mahogany. It is next alleged that the accused persons intended to took forceful possession of the land belonging to informant's mother and father.

Learned counsel for the petitioners submits that admittedly on account of land dispute the present occurrence has taken place. All the injuries sustained by the injured are simple in nature as it has come in the case diary. It is next submitted that from the side of the petitioners Kahalgaon P.S. Case No. 298 of 2021 has been instituted and from side of the petitioners also people have suffered injuries. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners but after perusing the case diary very fairly submits that the injuries suffered by the injured are simple in nature.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the

No.69775 of 2021(3) dt.26-07-2022 3/3 event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Kahalgaon (Shivnarayanpur) P.S. Case No. 293 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) Rishi/- U T
