JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 2 06-01-2016 Considering the rival submission in consonance with the order impugned, I do not see any cogent reason to interfere with the order impugned in the background of the fact that lis relates with regard to competency of the defendant no.5 to appoint the plaintiff and in between, there is no relevancy either of candidate register or service book. Accordingly, instant petition is rejected.
However, it is made clear that the suit is of the year 1988 and the conduct of the party suggests that any how he wants to drag the proceeding. Accordingly, the learned lower Court is directed to expedite the trial and dispose it of within six months without granting undue adjournment and will further communicate this Court with regard to compliance of the order
Patna High Court CWJC No.20538 of 2012 (2) dt.06-01-2016 2/2 after expiry of six months failing which the learned Presiding Officer will be held accountable and will be answerable for disobedience of the direction of the Court. Office is directed to communicate at once to District and Sessions Judge, Begusarai, who will keep surveillance over development of instant Title Suit No.102/1988 pending before learned Additional Munsif V, Begusarai.
