The petitioner has moved the Court for the following reliefs:- (i) For issuance of an appropriate writ in the nature of Certiorari, quashing the order vide Memo No. 09/Vya.Shi.-73/2006-242, Patna, dated 25.03.2014, issued under the signature of Deputy Director (Ma. Shi.), Education Department, Bihar, Patna by which the service of the petitioner has been terminated.

(ii) For issuance a Writ of

Patna High Court CWJC No.5264 of 2016 dt.18-08-2017 2/2 Mandamus, commanding and directing the concerned respondents to accept the joining of the petitioner on the post of Laboratory Assistant (Vyawasay, Mining Geology) in any suitable School on the vacant post.

(iii) For any other relief or reliefs, the petitioner is entitled to.

3. After some arguments, learned counsel for the petitioner submitted that he may be permitted to withdraw the writ application with liberty to file a representation before the respondent no. 2 for consideration of his grievances, as raised in the present writ application.

4. Learned counsel for the State does not object.

5. In view thereof, the writ petition stands disposed off as withdrawn with liberty aforesaid.

6. If such a representation is filed by the petitioner within three weeks from today, along with a copy of this order, before the respondent no. 2, the same shall be considered and disposed off by a reasoned order within four weeks from the date of its filing.
