The petitioners apprehend their arrest in connection with Gaurichak P. S. Case No. 178 of 2017 registered for the offences punishable under Sections 363, 365/34 of the Indian Penal Code.

Allegedly, Bablu Kumar the son of the informant went to his in-laws house from where he became traceless and when the informant went to search Babloo Kumar, the petitioners abused him.

Submission is of false implication and that Babloo Kumar has returned and his statement has been recorded under Section 164 Cr.P.C. wherein he has not stated regarding his kidnapping and as such the petitioners deserve sympathetic consideration.

Patna High Court Cr.Misc. No.55294 of 2017(3) dt.12-01-2018 2/2 Learned APP fairly submits that Babloo Kumar has not supported the allegation of kidnapping.

In the facts and circumstances stated above, the petitioners above named, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order, are directed to be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Patna in connection with Gaurichak P. S. Case No. 178 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
