The petitioner seeks bail in a case registered for the offences under Sections 395, 412 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 13.07.2021, charge-sheet has been submitted and has antecedent of three cases and the informant alleges that he along with his friend, Nikesh were intercepted by five unknown criminals who looted their motorcycle and two mobiles, further while fleeing, accused Manish was apprehended who disclosed the name of his associates including the petitioner.

The learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.69762 of 2021(2) dt.26-04-2022 2/3 petitioner was not arrested on the spot and his name came in the confessional statement of co-accused, Manish Kumar, and no incriminating articles were recovered from his possession nor he was put on T.I. Parade.

The learned A.P.P. vehemently opposes the bail application and submits that petitioner has antecedent of one case and once is released, he will delay the trial. Considering the fact that petitioner is in custody since 13.07.2021, charge-sheet has been submitted and his name transpired in the confessional statement of co-accused, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Gwalpara (Arrar O.P.) P.S. Case No. 47 of 2021, with a condition that one of the bailor of the petitioner shall be his father (Hareram Prasad Yadav).

Further, the petitioner in between 1 to 5 of every month commencing from May, 2022 will keep marking his attendance in the concerned police station till framing of the charges and in the event it is reported by the concerned police station to the learned Court below that the petitioner in between

Patna High Court CR. MISC. No.69762 of 2021(2) dt.26-04-2022 3/3 the aforesaid dates in any of the month before framing of the charge has not marked his attendance, the learned Court below will forthwith cancel the bail bond of the petitioner. The application stands allowed.
