JUSTICE PARTHA SARTHY ORAL ORDER 09-12-2019 Heard learned counsel for the petitioner and learned APP for the State as well as learned counsel for the informant. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Barabar Paryatan O.P. Bishnuganj P.S. Case No. 31 of 2019, registered for the offence punishable under sections 420, 467, 468, 471 and 120 B of the Indian Penal Code. As per allegation in the FIR, the petitioner had been appointed as Panchayat Shikshak, however, subsequently on the inquiry and verification of the certificates/marksheets, it was discovered that the marksheet relating to the BETET examination submitted by the petitioner was a forged document. Patna High Court CR. MISC. No.76765 of 2019(3) dt.09-12-2019 2/2 removed from being Panchyat Shikshak and he has not taken any amount for having worked as Panchayat Shikshak. The application for bail has been opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the fact and nature of allegations, as the petitioner is no longer continuing as Panchayat Shikshak, he having not received any amount for the worked done as Panchayat Shikshak and the petitioner having no criminal antecedent, the above named petitioner is directed to surrender in the Court below within a period of six weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Jehanabad in connection with Barabar Paryatan O.P. Bishnuganj P.S. Case No. 31 of 2019, subject to the condition as laid down under section 438(2) of the Cr.P.C.
