02. In the present case, the petitioner seeks bail in connection with Amour P.S. Case No. 252 of 2025 registered for the alleged offences under Sections 8 and 20(b)(ii) (B) of Narcotic Drugs & Psychotropic Substance Act.

03. As per prosecution case, police received information about co-accused keeping foreign liquor in his house and selling it. A raid was conducted in the house of the co-accused Md. Kasim who was apprehended. On search of the house, one electronic weighing scale and 2.448 kg. ganja were recovered and seized. On disclosure of the co-accused, his shop was also raided and from the shop, a lady fled away and this petitioner was apprehended while he was trying to flee away.

04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Nothing incriminating has been recovered from the person or possession of this petitioner. Merely 70 grams of ganja was recovered form the petitioner which is below the small quantity. The petitioner is in custody since 13.06.2025. The petitioner is having clean antecedent.

05. Learned APP for the State opposes the submission made on behalf of the petitioner. Learned APP submits that from the FIR, it is apparent that the petitioner was selling ganja after purchasing it from co-accused Md. Kasim.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the recovery of less than small quantity of contraband from the petitioner and also considering the period of custody of the petitioner and his clean antecedent, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, NDPS Act, Purnea/court concerned in connection with Amour P.S. Case No. 252 of 2025, subject to the conditions mentioned in Section

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
