Petitioner is accused in connection with Guraru P.S. Case No. 78 of 2015 registered under Sections 307, 353, 337, 427, 188, 504, 506, 109, 115, 324, 323, 342, 341, 147, 148, 149 of the I.P.C. and section 27 of the Arms Act.
The accusation is that the Police on receiving secret information about lying of dead body at the track near Railway Station went there and performed the legal formalities and boarded the dead body on tempo for postmortem at the Medical College, Gaya. In that course, when the tempo reached at Guraru Sugar Mill, about 200 miscreants, including 23 named in the F.I.R. along with the petitioner started bricks batting and closing the shop of
Patna High Court Cr.Misc. No.56398 of 2015 (2) dt.16-12-2015 2/2 the market and also started to make attempt to cause injury to the Police Force through stones. The police also fired to disperse the mob and any how, they managed to escape.
Learned counsel appearing on behalf of the petitioner submits that while the petitioner and 23 accused persons named in the F.I.R., including 200 unknown persons but no overt act has been alleged against the petitioner. It is also submitted that petitioner has no criminal antecedent and is in custody since 30.09.2015.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of J.M., 1st Class, Gaya in connection with Guraru P.S.
