Mr.Ajay Mishra ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-01-2019 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioners seek regular bail in connection with Kotwali P.S. Case No. 452 of 2018, registered for the offence punishable under Sections 417, 418, 419, 420, 466, 467, 468, 471 and 120(B) of the Indian Penal Code.

The allegation in the present case is regarding the mark-sheet, register and computer data base of B.E.T.E.T. 2011 examination having been tampered and forged by the employees of the Bihar School Examination Board. The learned counsel for the petitioners submits that the petitioners are Panchayat Teachers and not employees of the Bihar School Examination Board, hence, have got no

Moreover, the petitioners are non F.I.R. named accused persons, hence there is no complicity of the petitioners in the alleged occurrence. It is further submitted that some of the F.I.R. named accused persons have already been granted bail by a co-ordinate Bench of this Court by an order dated 04.12.2018 passed in Criminal Miscellaneous No. 69641 of 2018. The petitioners are stated to be languishing in custody since 21.07.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners on regular bail.

Accordingly, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned III Additional Sessions Judge cum Special Judge, CBI-II, Patna in connection with Kotwali P.S. Case No. 452 of 2018.
