The present writ application has been filed for a direction to the respondents to refund the entire amount with interest and adequate compensation for non-delivery of possession of the flat in question for which part payment was made by the petitioner. In view of the order dated 08.04.2009, passed in CWJC No. 14709 of 2001, learned counsel for the petitioner seeks permission to withdraw the present writ application, with liberty to challenge the said order passed by learned Single Judge in appropriate proceeding.

Patna High Court CWJC No.20151 of 2011(4) dt.23-01-2018 2/2 Permission is accorded.
