The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Asthawan P.S. Case no. 291/2020 instituted for the offence under Sections 364(A)/34 of the Indian Penal Code. Prosecution case relates to kidnapping the minor son, aged about 13 years, of the informant and two calls of ransom of Rs. Ten lac has been received by the dever of the informant by Mobile No. 9162753497 and 7595922668.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Statement of the victim boy was recorded under Section 164 Crpc, in which he has not taken the name of the petitioner. No.70171 of 2021(3) dt.12-07-2022 2/2 accused, namely, Gopi Kumar and Anuj Kumar who have disclosed the name of the petitioner as his associates and except confessional statement nothing has come against the petitioner during investigation. Similarly Situated co-accused has already been enlarged on bail by order dated 5.7.2022 passed in Cr. Misc. No. 61580 of 2021.

Learned APP appearing for the State has opposed the prayer of Bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Asthawan P.S. Case no. 291/2020, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of District & Sessions Judge Nalanda at Bihar Sharif subject to the conditions as laid down under section 438(2) of the Cr.P.C.
