Pursuant to order dated 01.12.2016, the Principal Secretary, Building Construction Department, Government of Bihar, Patna, is present and has filed his 4th and 5th supplementary counter affidavits. From Annexure-A/1 to the 5th supplementary counter affidavit, which is copy of office order No. 102, contained in Memo No. 11709 (Bha) dated 05.12.2016, it transpires that 9, Polo Road, has been allotted to the petitioner in lieu of 3, Bailey Road, from

Patna High Court CWJC No.14550 of 2013 dt.05-12-2016 2/2 where he has been shifted, on the same terms and conditions on which 3, Bailey Road, was being enjoyed by him. The Principal Secretary submitted that a formal communication of the aforesaid office order shall be served on the petitioner within one week from today.

In view of the aforesaid, the grievance of the petitioner in the writ petition having been redressed, the writ application stands disposed off.

Before parting, the Court would like to record its appreciation of the promptness shown by the Principal Secretary, who, despite having joined the Department only a few months back, has been able to ensure that justice is done to the petitioner and the matter which was hanging, only for completing a formality, is taken to its logical conclusion.

The personal appearance of the Principal Secretary, Building Construction Department, Government of Bihar, Patna stands dispensed with.
