JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-09-2025 Heard Mr. Manish Chandra Gandhi, learned counsel appearing on behalf of the petitioner and Mr. Umeshanand Pandit, learned APP appearing on behalf of the State.

2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 149, 323, 341, 392, 406, 420, 467, 468, 471, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per prosecution case, it is alleged that on the persuasion of this petitioner and other accused persons, husband of the informant purchased a land from one Karamu Ray and later on, the informant came to know that the alleged Karamu Ray was not real owner of the land in question and thus, this petitioner, along with other accused persons, cheated the

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is neither vendor nor vendee. Petitioner is only alleged to have introduced husband of complainant to Karamu Ray. Petitioner is neither identifier or seller of the alleged sale deed. It is not the case of the complainant that this petitioner received a single farthing as consideration money. Moreover, the dispute is with regard to sale and purchase of land, which is purely civil in nature and none of the acts allegedly committed by this petitioner would give rise to any criminal liability. Petitioner claims clean antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

6. Considering the facts and circumstances of the case, nature of accusation and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named
