In this application, the petitioner apprehends his arrest for the offences in connection with Puranhiya P.S. Case No. 63 of 2017 punishable under Sections 147, 148, 149, 323, 324, 307, 341, 354, 353, 440, 120-B of the Indian Penal Code. At the very outset, it is submitted that in this case similarly situated co-accused Upendra Sahani has been allowed pre-arrest bail by the learned court below itself whereas, other coaccused Rajesh @ Bhardul Sah @ Rajesh Sah and Kamlesh Sharma have already been allowed pre-arrest bail by another coordinate Bench of this Court vide Cri. Misc. No. 61816/17 and 58324/17 respectively. The FIR has been lodged against 70 named

Patna High Court Cr.Misc. No.63302 of 2017 (2) dt.02-02-2018 and 200 un-known persons. The petitioner has got no criminal antecedent and simply he was member of the mob and, as such, he deserves sympathetic consideration.

Learned APP fairly submits that Kamlesh Sharma and Rajesh @ Bhardul Sah @ Rajesh Sah have already been allowed pre-arrest bail.

Considering that against the petitioners there is no specific allegation and as such, the petitioner, in case of his surrender or arrest within four weeks from the date of receipt/production of a copy of this order shall be enlarged on bail on execution of bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Learned Subdivisional Judicial Magistrate, Seohar in connection with Puranhiya P.S. Case No. 63 of 2017 subject to the conditions as laid down in Section 438(2) of the Cr.P.C.
