JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Motihari P.S. Case No. 39 of 2019, registered for the offences punishable under Sections 366 (A)/34 of the Indian Penal Code.
Allegation against petitioner is that he along with other accused kidnapped the minor daughter of the informant. Submission of the learned counsel for the petitioners is that the victim girl is major and FIR itself shows that she has fled away with the son of the petitioner No. 1 and brother of the petitioner No.2 for the purpose of marriage, and they have solemnized marriage.
Patna High Court CR. MISC. No.57348 of 2019(2) dt.11-09-2019 2/2 Heard learned A.P.P. also who opposed the prayer of bail on the ground that the petitioners have criminal antecedent and victim is minor.
Heard both sides, in view of the allegation as discussed above, I am not inclined to grant privilege of anticipatory bail to the petitioners, however, the petitioners are directed to surrender before the learned Court below and make prayer for regular bail. In the meantime if the victim girl appear before the learned court below and her statement is recorded under Section 164 Cr.P.C. The Court below shall be considered the statement of victim recorded under Section 164 Cr.P.C. also while disposing of the bail application.
