It appears that during the pendency of the writ application an interlocutory application was filed by the legal heirs of the Petitioner to substitute them in his place to pursue the case. Grievance of the initial Petitioner was that he be regularized and respondents be directed to pay the arrears of due wages to the Petitioner.

A Counter Affidavit was filed on behalf of the Respondent Nos. 2 to 4 stating therein that the Petitioner had been removed from service in the year 1991 and hence, he had no legal claim.

Patna High Court CWJC No.16035 of 2006 dt.04-02-2015 2/2 Considering such aspect of the matter, the application is dismissed.
