JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-12-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324 and 307 of the Indian Penal Code. It is alleged that the petitioners along with one Baliram Sah came at the door of the informant and assaulted him by Dab causing bleeding injury, on his head, whereas Manjila Bibi and Masiran Bibi ensured rescue of the informant and then the petitioners and other caused injuries to them by pelting bricks. It has been submitted by learned counsel for the petitioners that the accusation is specific only against one Baliram

Patna High Court Cr.Misc. No.56627 of 2015 (2) dt.14-12-2015 Sah and for the occurrence of 10.09.2015 at 10:00 am the FIR was lodged on 11.09.2015 at 11:40 am. There is counter version of the occurrence also and the injuries have been found to be simple. A statement has been made in paragraph no. 3 that the petitioner has got no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge III, Saran (Bihar), in connection with Panapur P.S. Case No. 95 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ranjan/- U T
