20-12-2017 The present application has been filed for extension of time to surrender in the court below. Earlier, while disposing of the application bearing Cr. Misc. No. 50669/2017 (Binod Bharati and others vs. State of Bihar) vide order dated 18.10.2017 wherein eight accused were the petitioners, this Court had in the last part of the order given observation, whereunder, petitioners had to surrender within a period of four weeks from the date of the said order.

Learned senior counsel representing the present petitioners who are six in numbers submits that in fact two of the petitioners named in the Cr. Misc. No.

Patna High Court Cr.Misc. No.61693 of 2017 (2) dt.20-12-2017 50669/2017 had surrendered within the prescribed period of four weeks, but as these petitioners were outside the State and were working as labourers, they could not reach in time, hence, the present application.

Considering the facts and circumstances, let the period of four weeks be modified as period of four weeks from today, the period fixed in the last paragraph of the order dated 18.10.2017 passed in Cr. Misc. No. 50669/2017 will be deemed to have been extended to that extent.
