1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Magadh University Police Station Case No. 130 of 2023, dated 17.04.2023, disclosing offences under Sections 366-A of the Indian Penal Code.
3. The prosecution case, as per the First Information Report, is that on 14.04.2023, in the morning, the daughter of the informant, aged about 15 years, went to coaching centre and when she did not return till late in the evening, the informant made hectic search but could not trace her out. After some time the informant came to know that her daughter has been kidnapped by the petitioner.

4. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in the present case by his estranged wife. He further submits that the petitioner is father of the viticm girl and the informant is wife of the petitioner, who had left the petitioner and established relationship with another person and has been living with him. He next submits that the present First Information Report has been lodged in order to get custody of the girl child.
5. On the other hand, learned counsel for the State, referring to the case diary, submits that the victim girl, in her statement, recorded under Section 164 of the Code of Criminal Procedure, has stated that she had voluntarily gone to her Aunt's (Fua) house and nobody has kidnapped her.
6. Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation and the statement of victim girl recorded under Section 164 of the Code of Criminal Procedure, I am inclined to grant the petitioner privilege of anticipatory bail.
7. This application is, accordingly, allowed.

8. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Gaya, in connection with Magadh University Police Station Case No. 130 of 2023, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
