The petitioner has prayed for regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.
Prosecution case relates to theft of pick up van bearing registration no. RB-09GA-0946 and cash of Rs. 3,500/- from the informant.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Neither the petitioner is named in FIR nor he has put on TIP rather his name has come into light on the basis of confession made by co-accused
Patna High Court CR. MISC. No.58383 of 2022(2) dt.18-01-2023 2/2 namely, Chottu Kumar, before the police. It is further submitted that there is no recovery of stolen motorcycle from the possession of the petitioner. The petitioner is languishing in judicial custody since 22.12.2021.
Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bidupur P.S. Case No. 224 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur.
