JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. From perusal of impugned order, it would appear that petitioner has escaped from jail and subsequently, he was declared absconder in the present case. The petitioner was arrested on the strength of permanent warrant, issued against him and he is languishing in jail custody since 13-11-2014. Learned counsel for the petitioner submits that petitioner has sufficiently been punished by remaining in jail custody for near about one year but taking note of this fact that petitioner was absconded in the year, 2004 and he could be remanded in this case in the year, 2014 i.e. after 10 years of his escape, I do not think it proper to release him on bail.
Patna High Court Cr.Misc. No.56490 of 2015 (2) dt.14-12-2015 2/2 Accordingly, prayer for bail of the petitioner in connection with Paroo P.S. Case No. 68 of 1998 pending in the court of Sri Sanjeev Kumar Singh, learned Judicial Magistrate-Ist Class, Muzaffarpur stands rejected.
However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible even taking the trial of the petitioner on day-to-day basis. (Hemant Kumar Srivastava, J) A.K.V./- U T
