The petitioner seeks bail in connection with registered under Section 302, 201/34 of the IPC.
The accusation against the petitioner is that when the daughter-in-law of the informant, Asha Devi, along with her son, Surendra Yadav, were returning to home from the market in the way the petitioner and three others, named in the FIR, assaulted her and threw her in the field. In the meantime, Surendra Yadav came and informed the informant about the occurrence. Learned counsel appearing on behalf of the petitioner submits that allegation against the petitioner and others is of causing injury to the deceased and throwing her in the field but in
Patna High Court Cr.Misc. No.55485 of 2015 (2) dt.11-01-2016 2/2 the post mortem report no external injury was found on her body. The petitioner has no criminal antecedent and he is in custody since 21.08.2015 and similarly situated accused Putus Yadav has already been enlarged on bail vide order dated 15. 10.2015 passed in Cr. Misc. No. 42833 of 2015.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Gaya in connection with Tekari P.S. case No. 49 of 2015..
