The petitioner seeks bail in connection with Muzaffarpur Sadar P.S. Case No.557 of 2015 registered under Sections 212, 216, 399, 402 and 414 of the Indian Penal Code besides Section 25(1-b)a, 26 and 35 of the Arms Act and Sections 20/22 of the N.D.P.S. Act.
The prosecution case is that on receiving the information about assemblage of 9-10 persons on three motorcycles for making preparation of committing crime near the four lane road of village-Patahi, police party reached there and apprehended the petitioner and others. On their search, one live
Patna High Court Cr.Misc. No.56155 of 2015 (2) dt.15-12-2015 2/2 cartridge was recovered from the possession of the petitioner whereas from the possessions of the other apprehended persons arms and ammunitions were also recovered. It is also alleged that 1/2 kilograms Ganja was recovered from that place. Learned counsel appearing on behalf of the petitioner submits that the petitioner has no criminal antecedent and is in custody since 21.10.2015. The petitioner has falsely been implicated in this case showing the recovery of one live cartridge from his possession.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge-cum-Special Judge, Muzaffarpur, in connection with Sadar P.S. Case No.557 of 2015. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner.
