The petitioner is apprehending his arrest in a case registered under Sections 3⁄4 of Dowry Prohibition Act, 1961. The prosecution case, in brief, is that the marriage of informant's daughter was settled with the petitioner and thereafter, the accused persons started demanding Rs. 10,000,00/- (ten lacs) and a Bolero car in dowry and, on that basis, the petitioner refused to marry.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is a government employee working as Indian Coast Guard, posted at Ramnathpuram, Tamilnadu. The allegation,

Patna High Court Cr.Misc. No.3955 of 2019(2) dt.29-01-2019 2/2 made in the FIR is denied by the petitioner. The present prosecution has been filed only with a view to blackmail the petitioner and his family members. There is no other substantive evidence to suggest the implication of the petitioner in the present case.

On behalf of the State and the informant, it is submitted that the petitioner is named in the Complaint Case/F.I.R. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Saran at Chapra in connection with Dariyapur P.S. Case No. 107 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
