Mr.Dilip Kumar No. 1 ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 23-06-2023 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 332, 353, 186, 188 of the Indian Penal Code.

The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that he along with police force went to the place of occurrence and tried to reason out with the accused including the petitioners that they cannot forcefully usurp the government land, on which the accused persons abused and

The learned counsel for the petitioners submits that petitioners have been falsely implicated in the present case. It is next submitted that the land is not a government land rather the land on which the petitioners are residing, have been mutated in their favour.

Learned A.P.P. opposes the bail application.

Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st, Naugachia, Bhagalpur in connection with Bihpur (Bhawanipur) P. S. Case No.268 of 2022, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
