JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-12-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 379, 504, 34 of the Indian Penal Code and Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act.
It is alleged that petitioner came with 5-6 employees, assaulted and abused the informant by calling caste name, damaged the glass of the gym and took out cash of Rs. 15,000/-.
It is submitted by learned counsel for the petitioner that informant has not received any injury and subsequently the informant has retracted from the initial version and filed a petition to that effect before learned Court below.
A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.55738 of 2015 (2) dt.09-12-2015 2/2 petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Motihari Town P.S. Case No. 292 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
