1. Heard the learned counsel for the parties.

2. This application has been filed for appointment of petitioner as Notary Public as per the provision of law.

3. The paragraph no. 9 of the counter affidavit reads as follows:- "9. That it is further stated that the present petitioner participated in the said interview and received 34 marks therein. The qualifying marks in the said interview was fixed at 45 marks. Due to receiving less marks than the qualifying marks the present petitioner was declared failed."

4. In view of the paragraph no. 9 of the counter affidavit, this application is dismissed.
