====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 18-01-2019 Heard learned counsel for the petitioners and learned APP for the State.
Petitioners seek bail in connection with Patliputra P.S. Case No. 488 of 2018, instituted for the offence under Section(s) 419, 420, 467, 468 and 120B of the Indian Penal Code.
Counsel for the petitioners submits that one Fauji Kumar Singh was found giving examination of Railway Recruitment Board in place of Pankaj Kumar Paswan after taking Rs.10,000/-. Fauji Kumar Singh confessed his guilt and disclosed that other persons also involved in the occurrence are standing outside. Thereafter, Police apprehended Pankaj Kumar
Patna High Court Cr.Misc. No.2415 of 2019(2) dt.18-01-2019 2/2 Paswan and his brother Ranjit Kumar Paswan. Thereafter, petitioners are said to have been arrested by the police. As such, from the written report it appears that petitioners were not present on the spot. They were named by Pankaj Kumar Paswan after his arrest.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ratneshwar Kumar Singh, learned Additional Chief Judicial Magistrate cum sub Judge, 12th Patna, in connection with Patliputra P.S. Case No. 488 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
